Dexus (ASX:DXS) said one of the Dexus Bloc shareholders, REST Nominees No.2 as trustee of Rest Infrastructure Trust, filed with the Supreme Court of New South Wales, Court of Appeal, a notice of appeal from the court decision that the default notice is valid, according to a Thursday Australian bourse filing.

On May 16, 2025, Australia Pacific Airports (APAC) accused Dexus of breaching confidentiality obligations during a sale process involving stakes in Melbourne and Launceston Airports. Dexus was appointed in 2024 to lead the sale on behalf of certain shareholders.

A court had made orders dissolving injunctions referenced in a May 29 disclosure, meaning the forced sale process of the Dexus Bloc shares would continue, and its governance, board appointment, voting, and information rights were suspended, subject to the determination of any appeal.

The notice of appeal was set down for first directions on July 8, the filing said. The other Dexus Bloc shareholders have until June 26 to file any appeal.
