US Senator Warren Questions Capital One on Role of Trump's CFPB Nominee

US Senator Elizabeth Warren is putting pressure on Capital One over the role its executive, Brian Johnson, played in a regulatory agency's decision to drop an enforcement case against the bank. Johnson has been nominated by President Trump to lead the Consumer Financial Protection Bureau (CFPB).

The CFPB sued Capital One in January 2025, alleging the bank deceived consumers out of more than $2 billion in interest income by promising high-yield savings accounts it did not deliver. The lawsuit was filed just six days before Trump returned to the White House. However, roughly a month after the Trump administration took control of the agency, the CFPB voluntarily dismissed the case on February 27, 2025.

Johnson, who served as deputy director of the CFPB during Trump's first term, has been a vice president and US Card Compliance Officer at Capital One since November 2024. In a letter to Capital One CEO Richard Fairbank, Warren wrote that Johnson's position at the bank "raises significant concerns about his nomination," including whether he "directly or indirectly participated in the enforcement action, or advised Capital One on how to avoid accountability for its alleged misconduct."

Warren has demanded that Capital One provide all relevant communications between Johnson and the CFPB from November 2024 through June 2025 by July 7. Additionally, Warren inquired whether the Trump family would revive a "debanking" lawsuit against the bank. The Trump Business Trust sued Capital One in March 2025, alleging the bank closed over 300 of its accounts in 2021 for political reasons; that lawsuit is still ongoing.
