The Ministry of Human Resources and Social Security released the Measures for the Protection of the Rights and Interests of Workers in New Forms of Employment (Draft for Public Comment) on October 8, inviting public feedback from that day until November 8.
This marks the first time China has used regulatory measures to bring workers in new forms of employment—those under enterprise labor management but not fully meeting the conditions for establishing a labor relationship—into the protection of the labor legal system.
The draft adapts to the characteristics of new forms of employment, responds to concerns about labor protections for workers in these new forms of employment, clarifies the basic content of labor rights and interests protection, regulates labor rules and algorithms, classifies and regulates enterprise employment forms, opens up channels for resolving labor disputes, and specifies departmental regulatory responsibilities as well as legal liability for violating these Measures.
The draft includes provisions on minimum wage standards, working hours and labor intensity, rest periods, principles for determining labor remuneration, social insurance, and remuneration for work on statutory holidays.
