Guangdong Implements Multiple Measures to Enhance Intellectual Property Administrative Protection Quality and Efficiency

Guangdong has introduced new measures to standardize and strengthen the administrative adjudication process for patent infringement disputes, aiming to unify judgment standards and solidify the foundation of case handling while intensifying intellectual property administrative protection.

According to statistics released by the China National Intellectual Property Administration, from January to July this year, Guangdong Province handled a total of 644 administrative adjudication cases and concluded 714 cases, ranking first in the country in total case volume.

The provincial intellectual property office has been optimizing the hierarchical distribution of cases, clarifying the core adjudication responsibilities of municipal-level departments, and enhancing the coordination of major and complex cases at the provincial level. Leveraging the relevant provisions of the Guangdong Intellectual Property Protection Regulations, it adopts models such as commission-based case handling at the municipal level and joint case handling between cities and counties to strengthen the case-handling capacity of municipal offices, while also clarifying the collaborative responsibilities of county-level authorities and the professional support functions of protection centers.

Furthermore, the office has improved the mechanism connecting mediation and adjudication, standardizing the creation of mediation documents for parties who reach a settlement, and promptly adjudicating according to law when mediation fails, thereby reinforcing the rigidity of the administrative adjudication system. Guangdong has also been advancing reforms in the delegation of patent dispute adjudication, concentrating on the handling of major, difficult, and highly influential cases province-wide through the Guangdong Intellectual Property Protection Center.

Notably, the office has enhanced the dual technical fact-finding mechanism combining "professional review consultation plus technical investigators," strengthening on-site support from industry technical experts to overcome challenges in determining facts for high-tech and complex patent cases. It continues to deepen the integration of administrative and judicial procedures, standardizing adjudication and trial standards, and smoothing the path for judicial confirmation of administrative mediation, thereby promoting the substantive resolution of disputes.

Moving forward, Guangdong will continue to ramp up efforts, focusing on standardized and professional management to improve the normalized level of administrative adjudication for patent infringement disputes, providing solid support for high-standard intellectual property protection and high-quality development across the province.
