China has taken a major step to bolster intellectual property protections in its seed industry by implementing a new system for plant varieties.
The Ministry of Agriculture and Rural Affairs announced on July 27th a list of the first agricultural plant varieties subject to the essential derived variety system. Ten crops, including rice, wheat, and cotton, are included in this initial phase.
This marks the official launch of the essential derived variety system established by China's Seed Law, signaling a more robust framework for protecting seed industry innovation.
Understanding the New System
An essential derived variety is a new plant variety developed by modifying or improving an existing original variety. Compared to the original, only a few specific traits are changed.
As the seed industry revitalization initiative deepens, China's seed sector is entering a phase that relies more heavily on independent and original innovation. This requires a more stringent and reasonable intellectual property protection mechanism to stimulate original breeding innovation and accelerate the development of breakthrough new varieties.
Why Just These 10 Crops?
The first batch of crops was chosen based on urgent industry needs, good genetic diversity of the varieties, and mature variety identification technologies. These ten crops span five major categories: grain, cotton, oil crops, vegetables, and fruits, covering a wide range of sectors.
Their significance is underscored by the number of variety rights applications. As of the end of 2025, these ten crops accounted for a total of 38,600 applications, representing 35.5% of all agricultural plant variety rights applications in China.
Ensuring the System is Actionable
To ensure the system's operability, the Ministry has also released guidelines for determining essential derived varieties, judgment thresholds, and conditions for appraisal agencies. An expert database has also been established.
Looking Ahead
The Ministry of Agriculture and Rural Affairs will consider China's national conditions, agricultural needs, breeding capabilities, and technical conditions to gradually expand the list of applicable crops. The ultimate goal is to cover all plant genera and species listed in the agricultural plant variety protection directory, fostering original innovation on a much larger scale.
